By accessing, browsing, or using Datacentres.com (the "Platform"), including all content, tools, data, reports, and services, you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately cease all use. We may modify these Terms at any time without prior notice. Continued use constitutes acceptance of modifications.

2. Description of Services

The Platform provides data centre and industrial real estate market intelligence including:

  • Market data and analytics across global data centre and industrial markets
  • Transaction tracking, comparable sales data sourced from third-party providers including CoStar Group
  • Facility and provider directories compiled from public sources
  • Interactive tools: site selection scoring, cost calculators, market comparison, viability assessments
  • Industrial submarket data across approximately 2,941 submarkets
  • Leasing availability data from third-party providers
  • Industry news, analysis, and research reports
  • Advisory referral services connecting users with licensed real estate professionals

The Platform is for informational and educational purposes only. We do not operate data centre facilities, broker transactions, or provide investment advice.

3. No Professional Advice

THE PLATFORM DOES NOT PROVIDE PROFESSIONAL ADVICE OF ANY KIND, INCLUDING:

  • Investment, financial, or securities advice or recommendations
  • Legal advice or legal opinions
  • Tax advice or tax planning
  • Real estate brokerage services (unless through separately engaged licensed professionals)
  • Engineering, architectural, or construction advice
  • Environmental assessments or compliance guidance
  • Appraisals or formal property valuations

All data, scores, estimates, and projections are indicative only. Users must obtain independent professional advice before acting on any Platform information.

4. Data Accuracy and Third-Party Sources

Data is compiled from CoStar Group, public press releases, SEC filings, industry reports (CBRE, JLL, Cushman & Wakefield), operator websites, government agencies, and proprietary research.

WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, OR CURRENCY OF ANY DATA OR INFORMATION ON THE PLATFORM.

Data may contain errors, omissions, or be outdated. Transaction data may reflect allocated values from portfolio sales. Capacity figures, vacancy rates, lease rates, and construction costs are estimates that may vary significantly from actual values. Tool outputs are rough approximations and should not be treated as professional analysis.

5. Interactive Tools Disclaimer

Interactive tools include Site Selection Score, Cost Calculator (lease and build), Market Comparison, Edge Conversion Analysis, Land/Office Viability Assessment, and Power Availability Tracker.

ALL TOOL OUTPUTS ARE INDICATIVE ESTIMATES ONLY. THEY ARE NOT APPRAISALS, VALUATIONS, ENGINEERING ASSESSMENTS, OR PROFESSIONAL OPINIONS. DO NOT MAKE DECISIONS BASED SOLELY ON TOOL OUTPUTS WITHOUT INDEPENDENT PROFESSIONAL VERIFICATION. Scoring algorithms use simplified models that cannot account for site-specific conditions, local regulations, utility capacity, environmental factors, or market dynamics.

6. Advisory Referral Services

The Platform connects users with licensed real estate professionals. Submitting any form does not create a client relationship, agency relationship, fiduciary duty, or advisory obligation. Advisory services are provided by separately engaged licensed professionals under separate agreements. Datacentres.com acts solely as a referral and intelligence platform, not as a licensed brokerage, investment advisor, or fiduciary.

7. Use Restrictions

  • No scraping, harvesting, or systematic data extraction
  • No automated access via bots or scripts
  • No reproduction or commercial exploitation of data or analysis
  • No redistribution of CoStar-sourced data (subject to CoStar's terms)
  • No interference with Platform infrastructure or security
  • No use for unlawful purposes

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, UNINTERRUPTED SERVICE, AND RESULTS FROM USE. NO ADVICE OBTAINED THROUGH THE PLATFORM CREATES ANY WARRANTY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATACENTRES.COM AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL
  • DAMAGES FROM RELIANCE ON ANY DATA, CONTENT, OR TOOL OUTPUT
  • DAMAGES FROM ANY TRANSACTION OR INVESTMENT DECISION INFLUENCED BY PLATFORM CONTENT
  • COST OF PROCUREMENT OF SUBSTITUTE SERVICES

REGARDLESS OF THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID TO US IN THE PRECEDING 12 MONTHS, OR (B) $100 USD.

10. Indemnification

You agree to indemnify, defend, and hold harmless Datacentres.com and its owners, officers, directors, employees, agents, affiliates, and licensors from all claims, damages, losses, costs, and expenses (including attorneys' fees) arising from: (a) your use of or reliance on the Platform; (b) violation of these Terms; (c) violation of third-party rights; (d) information you submit; (e) any decision made based on Platform information; (f) any third-party claim related to your use.

11. Assumption of Risk

You acknowledge that: (a) real estate and infrastructure investments involve substantial financial risk; (b) market data and projections are inherently uncertain; (c) regulatory, grid, and market conditions can change rapidly; (d) the Platform cannot account for all decision-relevant factors; (e) you assume all risk from decisions made using Platform information. You waive all claims against Datacentres.com arising from the accuracy, completeness, or usefulness of any information, data, or tool output.

12. No Regulatory Registration

The Platform is not registered with any securities commission, financial regulatory authority, or real estate licensing body. Nothing constitutes an offer to sell or buy any security or real estate interest. Users are responsible for compliance with all applicable laws in their jurisdiction.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA. Disputes shall be resolved through binding arbitration under the American Arbitration Association Commercial Rules in Wilmington, Delaware. Arbitration is individual only. YOU WAIVE ANY RIGHT TO CLASS ACTION OR CLASS-WIDE ARBITRATION.

14. Severability and Entire Agreement

If any provision is invalid, remaining provisions continue. These Terms and our Privacy Policy constitute the entire agreement. No waiver of any provision is a continuing waiver.
